Terms of Sale

These Terms of Sale govern all purchases made on www.stickergorillas.com. By placing an order, you agree to be legally bound by these terms.

1. 100% Custom Nature of Our Products
Every single item sold on our website—**including our Sample Packs**—is custom-manufactured, printed, and cut to your exact specifications (individual artwork, custom sizes, unique finishes, and selected quantities). Because these personalized products cannot be resold to anyone else, **all sales are strictly FINAL. Custom items are non-returnable and non-refundable**, except in verified cases of severe manufacturing defects directly attributable to StickerGorillas (as outlined in Section 6).

2. Order Process, Digital Proofs & Production Timeline
 **Artwork Submission:** We print directly from the digital files you upload. You warrant that your artwork files are formatted correctly according to our artwork preparation guides.
**Direct-to-Print:** To maximize fulfillment speed, if your uploaded file is fully production-ready and no digital proof is explicitly requested, we may process it directly into print.
 **Proof Approval Process:** If a digital print proof is prepared by our design team, it will be emailed to you. **Standard production (5–7 business days) begins strictly AFTER you explicitly approve the digital proof.** * *Note: Any delays in reviewing or approving your digital proof will directly extend the production timeline.*

3. Changes, Cancellations & EU Withdrawal Waiver
**2-Hour Grace Period:** You may request minor modifications or complete cancellations within exactly **2 hours** of placing your order by emailing [email protected]. 
 **No Adjustments After Production:** Once the 2-hour grace period expires or your digital proof is approved, your order instantly enters our automated manufacturing workflow. Beyond this point, no cancellations, text/graphic edits, size adjustments, or refunds are possible.

**⚠️ EU CONSUMER REGULATION WAIVER:** In accordance with **Article 16(c) of the EU Consumer Rights Directive (Directive 2011/83/EU)** and updated **Directive (EU) 2023/2673**, consumers do not possess a 14-day right of withdrawal for custom-made or personalized goods. By finalizing your checkout and approving your artwork, you expressly acknowledge and agree that **you waive your 14-day right of withdrawal/cooling-off period.**

4. Pricing, Taxes & Duties
All prices are clearly stated at checkout. International shipments may be subject to import VAT, GST, customs duties, and local clearance fees.
* **EU Orders under €150:** If dynamic EU VAT is automatically calculated and collected at checkout via our IOSS system, no additional import VAT should be due at delivery. 
* **General International Orders:** Unless DDP (Duties Delivered Paid) is explicitly agreed upon in writing by our team, all local import taxes and customs fees are the sole legal responsibility of the recipient.

5. Delivery & Risk of Loss
Except as provided below, legal title and the risk of loss or damage pass to you the moment your order is transferred to our shipping carrier. While we will aggressively assist you with carrier investigations if a parcel is delayed or lost in transit, our liability is bound by Section 11.
**EU Consumer Carve-Out:*** If you are a consumer purchasing from within the European Union, the risk of loss or damage to the goods transfers to you only when you (or a third party designated by you) take physical possession of the parcel.

6. Quality Claims & Manufacturing Defect Resolution
If you believe your custom products possess a verified manufacturing defect caused by StickerGorillas, you must submit a claim to **[email protected] within 7 calendar days of delivery**. Your claim must include:
1. Your exact Order Number.
2. High-resolution, clear photos showing the entire batch, close-ups of the error, the outer packaging, and the carrier shipping label.
3. A detailed written description of the discrepancy.

**Resolution:** If our production audit confirms a defect, we will, at our sole discretion, either issue a **priority free reprint** or a **refund** for the defective portion of the order. We reserve the right to request that up to three (3) physical samples be mailed back to us for inspection (we will provide a prepaid shipping label if necessary).

Covered Manufacturing Defects:
* Complete mismatch of item type, material finish, dimensions, or quantity vs. your finalized order or approved digital proof.
* Severe mechanical printing artifacts (heavy banding lines, catastrophic ink smudges) or a severe visual color shift radically departing from the approved proof.
* Machine misalignments in die-cutting or kiss-cutting exceeding our standard technical tolerances, rendering the stickers unusable.

Explicitly EXCLUDED from Coverage (Non-Defects):
 Low-quality prints resulting from low-resolution, blurry, pixelated, or poorly prepared source files provided by the customer.
 Typographical errors, spelling mistakes, or layout flaws present in the user-submitted design.
**Color Variance:** Minor visual color variations (up to ~10%) resulting from the CMYK printing process across different vinyl substrates and laminate materials vs. RGB backlit computer screens.
 **Cut Variance:** Mechanical alignment shifts of **up to ±1.5 mm** relative to the specified cutline (white borders or full-bleed designs may shift accordingly within this threshold).
 Post-delivery wear and tear, improper application to uncleaned, textured, oily, or non-compatible surfaces, or chemical/weather exposure exceeding the material's rated specifications.

7. Returns & Refunds Processing
* Because our products are entirely custom, unauthorized physical returns sent back to our facility without an approved quality claim will be rejected and discarded.
* Approved refunds are processed back to your original payment method within ten (10) business days. **Original shipping costs are strictly non-refundable** unless the entire shipment is deemed completely unusable due to our direct error.

8. Sample Packs Classification
For the avoidance of doubt, our **Sample Packs are fully customized products** created based on your uploaded individual images or designs. Consequently, they are bound under the same custom product restrictions outlined in Section 1 and Section 6, and are strictly non-returnable.

9. Intellectual Property & Customer Indemnification Warranty
By submitting artwork or brand assets to stickergorillas, you represent and warrant that you hold undisputed copyright, trademark, or legal licensing authorization for those graphics. 
You grant us a limited, non-exclusive license to replicate the artwork solely to manufacture your order.
**Copyright Indemnity:** You agree to fully indemnify, defend, and hold harmless StickerGorillas and its personnel from any third-party lawsuits, legal damages, liabilities, and legal/attorneys' fees arising out of allegations that the custom printing of the artwork provided by you infringes upon any trademark, copyright, or proprietary asset of a third party (e.g., unauthorized printing of corporate logos or protected media characters).

10. Technical Tolerances
By finalizing your checkout, you contractually accept that custom printing involves industrial mechanical machinery bound by the standard technical tolerances of ±1.5 mm for cutting alignment and up to ~10% visual variance for CMYK digital printing.

11. Limitation of Liability
To the maximum extent permitted by applicable law, the total aggregate liability of StickerGorillas for any claim, loss, or defect shall never exceed the exact monetary amount you paid for the specific defective portion of the order. We shall not be liable for any indirect, incidental, or consequential commercial losses (such as missed business event deadlines, lost profits, or third-party marketing overheads).
* ***EU Consumer Carve-Out:*** For EU residents, nothing in these terms limits our liability for gross negligence, willful misconduct, or fraud.

12. Governing Law & Jurisdiction
These Sales Terms shall be governed by and construed in accordance with the laws of the jurisdiction where StickerGorillas is legally registered.
***EU Consumer Carve-Out:*** Consumers residing in the EU may bring legal disputes to enforce their mandatory consumer rights before the competent local courts of their home EU Member State.
